So Many Cool Ideas is a service of SMCI Media LLC, a Florida limited liability company. These terms cover your use of this website and the work we do for you if you commission a project. By using the site you agree to them.

Using this website

You are welcome to read the site, follow the links and send us your idea. Please do not use the site to break the law, to try to gain unauthorised access to it or anything connected to it, to interfere with how it runs, or to harvest data from it automatically beyond ordinary search engine crawling.

Nothing here is a binding quote

The tiers and descriptions on this site explain the kind of work we do. They are not fixed prices and not an offer capable of acceptance. A price becomes real when we send you a written quote for your specific project and you accept it. Sending the form does not commit either of us to anything.

Our promise, and exactly what it means

That promise is real and we intend to honour it. Two things make it work fairly in both directions:

• Ownership passes when you pay. Until the invoice is settled, the work remains ours. Deciding not to pay means deciding not to use it, and we may take down or disable anything we have deployed for you.
• It covers our work, not third-party costs. If a project needs a domain name, a paid service, a licensed font or a stock image bought in your name, those are yours to pay for whether or not you go ahead with us. We will tell you before anything like that is bought.

Revisions along the way are part of the job and we are happy to make them. Where a request goes beyond what was quoted, we will say so and re-quote rather than quietly absorb it or quietly bill for it.

What you provide

You are responsible for the accuracy of the content you give us, and for having the right to use it. If you supply text, logos, photographs or other material, you confirm you are allowed to use them and to let us publish them on your behalf.

Ongoing services

If we host or maintain something for you after it is built, that is a separate ongoing arrangement described in its own quote or agreement. Either of us can end it with reasonable notice. If it ends, we will help you move your site and your data somewhere else rather than hold either hostage.

Printable games and other digital products

Printable games sold through this site or through a marketplace are licensed for personal or single-classroom use unless the product says otherwise. You may print them as often as you like for that use. You may not resell them, redistribute the files, or publish them online. Where a product is bought through a marketplace, that marketplace's own refund policy governs the purchase.

No professional advice

Nothing on this site is legal, financial, tax or other professional advice. If a project touches something that needs a professional opinion, get one.

Availability

We do not promise the site will always be available or free from faults, and we may change or withdraw parts of it. Where we host a live service for you, availability commitments are whatever the agreement for that service says, and nothing here overrides them.

Limitation of liability

To the fullest extent the law allows, SMCI Media LLC is not liable for indirect or consequential loss, for lost profits, or for loss of data, arising out of this website or the services. Our total liability connected with a project is limited to the amount you actually paid us for that project. Nothing in these terms limits any liability that cannot lawfully be limited.

Governing law

These terms are governed by the laws of the State of Florida, and the courts of Florida have jurisdiction over any dispute arising from them.

Changes

We may update these terms. The current version is always the one on this page, with the date at the top. Changes do not alter the terms of a quote you have already accepted.
